Terms of use

These terms are an agreement between you and IGOR BEZRUCHKO PR BEOGRAD ("we"), the operator of Misty. By creating an account or using the Misty apps or mistys.co, you accept them. If you do not accept them, do not use Misty.

The service

Misty is an encyclopedia of perfumes: their houses, notes, perfumers and bottles, and what people think of them. You can keep perfumes on shelves, write notes and reviews, and photograph a bottle to find out what it is.

The encyclopedia is gathered from many sources and may contain mistakes. Recognition from a photograph is a best guess, not a guarantee. Misty does not sell perfumes, and the names, brands and pictures of perfumes belong to their owners; showing them does not mean their owners endorse Misty.

Your account

You must be at least 16 years old to create an account. Give accurate information when you sign up, keep your sign-in details secure, and tell us at hello@mistys.co if you think someone else has used your account. You are responsible for what happens in your account.

Your content

The notes, reviews, photographs and other content you put into Misty stay yours. You give us a worldwide, non-exclusive, royalty-free permission to store, copy, process and display them as needed to run Misty: to sync your library between your devices, to show your reviews to other people, and to use the photographs you search with to improve recognition. This permission ends when you delete the content or your account, apart from any copy the law requires us to keep and reference pictures that are no longer linked to you.

You are responsible for having the right to publish what you post. Reviews must be your own honest experience.

Community rules

Reviews and photographs are seen by everyone, so keep them about the perfume. Do not post:

• anything unlawful, hateful, harassing or sexually explicit;
• other people's personal information, or photographs of people who have not agreed to it;
• advertising, spam or reviews you were paid for without saying so;
• content you do not have the right to share.

Moderators may hide a review or photograph, close reviews of a perfume, or stop an account from reviewing when these rules are broken.

Acceptable use

Do not:

• break the law or help anyone else break it with Misty;
• try to access other people's accounts or data;
• scrape, bulk-download or copy the encyclopedia, or probe, overload or disrupt our systems, or get around their security or usage limits;
• copy, resell or reverse-engineer Misty, except where the law allows it.

We may suspend or close an account that breaks these rules.

Price

Misty is currently free. If we introduce paid features, we will tell you the price before you pay anything, and these terms will be updated.

Changes and availability

Misty is new and will change. We may add, change or remove features and entries in the encyclopedia. We aim to keep the service available but do not promise that it will be uninterrupted or error-free.

Ending your use

You can stop using Misty and ask us to delete your account at any time by writing to hello@mistys.co. We may suspend or close your account if you break these terms, or stop offering Misty with reasonable notice.

Disclaimers

Misty is provided "as is" and "as available". As far as the law allows, we make no promises about it beyond those in these terms, including about the accuracy of the encyclopedia or of recognition, fitness for a particular purpose or uninterrupted access. Check a perfume's ingredients with its maker if you have allergies or sensitivities.

Liability

As far as the law allows, we are not liable for indirect or consequential losses, or for lost profits, data or opportunities, arising from your use of Misty. Nothing in these terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, or for fraud. If you are a consumer, you keep all the rights your local law gives you.

Governing law

These terms are governed by the law of the Republic of Serbia. If you are a consumer, you keep the protection of the mandatory consumer law of the country where you live, and you can also bring a claim in its courts.

Changes to these terms

When we change these terms we update the effective date at the top. If a change is significant, we tell you in the app or by email before it takes effect. If you keep using Misty after that, the new terms apply.
